Terms of Use

These Terms of Use set out the rules and restrictions governing the use of our applications, products, services, and websites (the « Services »). These Terms constitute a legally binding agreement between AQUA NUHA and users of its Services.

By completing the registration process and/or by browsing the Services, you acknowledge that you are of legal age and legally capable, and you confirm that you have read, understood, and accepted these Terms.

You must not access or use the Services unless you agree to be bound by all of these Terms.

Article 1 – Scope of application

These Terms are established by AQUA NUHA, which operates a website and applications that may offer features, products, services, or content, including information exchanges for the benefit of end users.

The use of certain Services is subject not only to these Terms of Use, but also to general terms and conditions of sale, as well as privacy and cookie policies describing how we process personal data.

These Terms may be amended in order to improve the Services offered, comply with legal or regulatory requirements, address security issues, and/or ensure the continuous operation and performance of the Services.

We will notify you within a reasonable timeframe of any material changes by email or through other channels, in accordance with applicable laws, so that you may review them before they take effect.

If you do not agree with these changes, you must stop using the Services before they take effect. We encourage you to regularly review these Terms to stay informed of the latest version.

Article 2 – User capacity and status – Registration

To use the Services, the user must be of legal age, legally capable, and act for personal purposes.

To access or use certain Services, the user may be required to create an account. When creating an account, the user agrees to provide truthful, accurate, complete, and up-to-date information about themselves, including contact details, and to keep such information updated. The user may create and use only one account.

The user is responsible for all activities carried out through their Account and undertakes to monitor access to their Account in order to prevent its use by third parties or by persons who do not meet the required capacity or eligibility criteria.

The user agrees to use the Services solely for personal use, and not on behalf of or for the benefit of a third party, and only in a manner that complies with these Terms, the applicable Policies, and all applicable laws and regulations.

AQUA NUHA reserves the right to suspend or ban users in the event of a violation of these Terms or our Policies.

Article 3 – Confidentiality

As part of the Services offered, AQUA NUHA may recommend features, products, and services, including third-party advertisements, that may be of interest to you.

AQUA NUHA identifies user preferences and personalizes the user experience.

The Privacy Policy provides details on how AQUA NUHA collects, uses, and discloses your personal information when you access, browse, or use the Services. In using the Services, the user acknowledges and agrees that AQUA NUHA may collect, access, use, store, and disclose personal information (including Account and user information) as described in these Terms and in the Privacy Policy, which the user acknowledges having read.

Article 4 – Communications

The user agrees that AQUA NUHA may communicate with them electronically, including by email, SMS messages, mobile push notifications, and any other notifications or messages.

Such communications may be necessary, in particular, for the creation, management, or updating of user accounts, to use a service, place and track an order, or handle after-sales service issues.

The user acknowledges and agrees that all terms, agreements, notices, disclosures, and other communications and documents sent electronically shall have the same legal effect as those sent “in writing,” subject to any mandatory legal provisions requiring a different form of communication.

The user may also choose to subscribe to receive marketing materials from AQUA NUHA via text message, email, or other channels. Subscription to one channel does not automatically imply subscription to another, and the user may unsubscribe from marketing communications at any time by following the instructions provided.

The user also has the option to register their telephone number on the telephone solicitation opt-out list available at www.bloctel.gouv.fr.

Communications may also be carried out through third-party service providers. Subject to the Privacy Policy, the user agrees that communications with them or with partners may be recorded, monitored, and stored for quality control and training purposes, or to protect the interests of the various parties and stakeholders.

Article 5 – Reviews, comments, and other content

Visitors may post comments or other content; send electronic greeting cards or other communications; and submit suggestions, ideas, questions, or other information, provided that such content is not illegal, obscene, abusive, threatening, defamatory, libelous, infringing intellectual property rights, harmful to third parties, or otherwise objectionable, and does not consist of or contain computer viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any other form of « spam ».

The user must not use a false email address, impersonate any person or entity, or misrepresent the origin of a credit card or any content.

If you post customer reviews, questions/answers, or any other content generated by you for publication on a website, you grant AQUA NUHA the right to use, reproduce, publish, make available, and translate such content without compensation.

Article 6 – Liability

AQUA NUHA is an online platform that enables the sale of products and services to user clients.

The core functionalities of AQUA NUHA include:

• providing access to and use of the platform ;
• issuing login credentials to access your Administration Interface ;
• providing a Seller Store where products and services are offered ;
• providing an approved online payment service.

The platform and application functionalities may evolve at any time. AQUA NUHA undertakes to ensure that such developments do not result in a regression of core functionalities or a loss of user data. AQUA NUHA may need to adapt its platform and application to technologies and standards used on the Internet. These changes may require users to update their web browsers. AQUA NUHA shall not be held liable for access malfunctions resulting from a user’s refusal to keep their IT equipment up to date.

Access to AQUA NUHA Services is provided via the Internet, primarily through the website www.aquanuha.com. The hardware and internet connection required to access the Services remain at the user’s expense and are not provided by AQUA NUHA.

AQUA NUHA will use reasonable efforts to ensure that its Services are available as close as possible to 24 hours a day, 7 days a week ; however, AQUA NUHA is subject only to an obligation of means.

As the Partner’s professional activity does not depend essentially on the continuous availability of the Services, temporary periods of unavailability may occur at any time of the day.

Please note that:

• Access to and use of the Services may be interrupted or slowed for reasons beyond our control, including congestion at the national or global Internet network level.

• Occasional maintenance operations and corrective actions may result in temporary service interruptions.

AQUA NUHA Services may be interrupted for maintenance or update purposes. We endeavor to inform you in advance of any scheduled interruptions and, where possible, to carry them out during off-peak hours. However, certain emergency interventions may require action at any time of day without prior notice.
